Terms and Conditions

1. Acceptance of Terms

By accessing or using the JamDrive application (the "App"), website, or any related services (collectively, the "Services"), you ("User," "you," or "your") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not access or use the Services.

2. Description of Services

JamDrive is a platform that connects drivers and passengers. The Services include, but are not limited to:

• Facilitating connections between drivers and passengers.
• Processing payments for rides.
• Providing user profiles and communication features.
• Offering customer support.
• An Affiliate & Referral Program that allows users to earn commissions by referring new users to the platform.
• A RevenueWallet system for managing earnings, tracking pending payouts, and requesting withdrawals.

3. User Accounts

• Eligibility: You must be at least the legal age of majority in your jurisdiction to use the Services.
• Account Creation: You must create an account to use certain features. You agree to provide accurate, current, and complete information.
• Account Security: You are responsible for maintaining the confidentiality of your account credentials.
• One Account Per Person: Duplicate or fake accounts are strictly prohibited and may result in permanent suspension and forfeiture of all earnings.
• Account Suspension/Termination: We reserve the right to suspend or terminate your account at any time.

4. Ride Services

• Driver Responsibilities: Drivers are independent contractors and are solely responsible for the safety and legality of their vehicles.
• Passenger Responsibilities: Passengers are responsible for their own conduct during rides.
• Ride Requests and Acceptance: We do not guarantee that a ride request will be accepted.
• Cancellations: Cancellation policies may apply to both drivers and passengers.

5. Payments

Payments for rides are processed through a third-party payment processor (e.g., Stripe). You agree to comply with their terms and conditions.

6. Affiliate & Referral Program

The Affiliate & Referral Program allows users ("Affiliates") to earn commissions by referring new users to the JamDrive platform.

• Referral Codes: Each Affiliate receives a unique referral code. When a new user registers using that code, the Affiliate may earn a commission subject to these Terms.
• Commission Eligibility: Commissions are earned only when the referred user completes a qualifying action (e.g., first completed ride). No commission is earned solely for registration.
• Commission Payment: Commissions are credited to the Affiliate's RevenueWallet. Minimum withdrawal thresholds apply. JamDrive may hold or forfeit commissions pending fraud review.

7. Prohibited Activities — Fraud & Abuse Prevention

The following activities constitute fraud and abuse of the Affiliate & Referral Program and are strictly prohibited:

• Self-Referrals: Referring yourself using your own code, whether through your own account or any account under your control.
• Fake Accounts: Creating multiple accounts, fake identities, or using bots to generate referrals.
• Referral Farming: Incentivizing sign-ups solely for commission without genuine intent to use the platform.
• Code Manipulation: Altering or tampering with referral links or codes to misattribute referrals.
• Misleading Marketing: Using spam, unsolicited messages, or impersonation to promote referral codes.
• Transaction Fraud: Creating fake transactions to trigger commission payouts.

Consequences: If JamDrive determines any prohibited activity has occurred: all pending and future commissions shall be forfeited, previously paid commissions may be clawed back, the account may be suspended or terminated, and JamDrive reserves the right to seek legal remedies.

Wallet Freeze: JamDrive may freeze any RevenueWallet pending investigation of suspected fraud. Frozen funds may be forfeited if fraud is confirmed.

8. RevenueWallet

• Wallet funds belong to the account holder but remain under JamDrive's custody. No interest is earned on balances.
• Withdrawals are subject to review, approval, and minimum/maximum amount thresholds.
• Inactive wallets with zero balance for 12 months may be closed. Balances from terminated accounts are forfeited.
• Affiliates must complete payment processor verification before any payout can be made.

9. User Conduct

You agree not to use the Services for any illegal purpose, impersonate others, harass users, or interfere with the operation of the Services.

10. Intellectual Property

All content and materials on the Services are owned by or licensed to us and are protected by intellectual property laws.

11. Disclaimer of Warranties

The Services are provided "as is" and "as available" without any warranties of any kind, express or implied.

12. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages arising out of your use of the Services, including but not limited to loss of referral commissions or wallet balance. Our total liability shall not exceed the greater of $100 or the total commissions paid to you in the preceding 12 months.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Your continued use of the Services after changes constitutes your acceptance.
